Built once, then largely left alone

ZIP code tabulation area 11104 holds about 13,174 homes: 48.4 percent in structures finished before 1940, 39.4 percent between 1940 and 1969, 92.2 percent before 1980, and 2.2 percent built in 2010 or later (table B25034). By units in structure, 43.2 percent are in buildings of 50 or more and 19.5 percent in 20 to 49; close to three-quarters of homes are in a building of ten units or more (table B25024). Owner-occupancy is 20.4 percent; utility gas heats 70.9 percent of homes and fuel oil 13.5 percent (table B25040), all ZIP-wide.

City Planning records how that came about: "During the 1920's and 30's, numerous six-story, multi-family apartment buildings were built in Sunnyside, while construction of one- and two-family homes and small apartment buildings predominated in Woodside." (Sunnyside-Woodside rezoning). The two names get merged constantly; the stock is not the same.

Sixteen blocks under two sets of rules

Sunnyside Gardens takes in "all or portions of the 16 blocks generally located between 43rd and 52nd streets, Queens Boulevard and Barnett Avenue" (Sunnyside Gardens text amendment). Landmarks designated it on 26 June 2007 as LP-2258, Designation List 393 (designation report). The report describes "a series of twelve 'courts' (composed of rows of townhouses and small apartment buildings)", more than 600 buildings in all, Harrison Place, Jefferson Court and Wilson Court Apartments among them, with the Phipps Garden Apartment buildings added to the designated area. The summary dates construction to 1924 through 1928, the general description to 1924-28, 1931-2 and 1935, so not every building is from the twenties. Landmarks quotes: "economy of construction is achieved through simplicity of design and through the use of common brick". Common brick laid that way is solid masonry, no cavity behind it, which limits the insulation and fixings available later.

The zoning arrived first. "In 1974, the New York City Planning Commission designated the area a 'Special Planned Community Preservation District' (one of four in the city)" and required permits for exterior changes to buildings and landscape, the report says. Before that, private covenants ran the place: no change to a house front or rear "without permission of the trustees of each court association", lasting "only for forty years" at the mortgage banks' insistence. Nothing opened here records what became of them; the 1974 district and the 2007 designation govern an exterior change now. A 2009 text amendment aimed to "eliminate duplicative reviews", and the vote turns on what buyers ask about: "With resolution as to how the Landmarks Preservation Commission will regulate changes to the rear yard portions of the Gardens, the City Planning Commission voted to approve the Sunnyside Gardens text amendment on April 22nd, 2009." The district carries "a uniform .75 FAR with a .15 FAR attic allowance and a 35-foot maximum building height", and "R4 infill zoning provisions were prohibited throughout" (Sunnyside-Woodside rezoning). The envelope you buy is close to the envelope you keep: a deck, a fence, a window or a change to the common garden is a permit question first.

Beyond the Gardens

"On July 28, 2011, the City Council adopted the Sunnyside - Woodside Rezoning" (Sunnyside-Woodside rezoning), covering "all or portions of 130 blocks" in Community District 2 and allowing moderate growth along "Queens Boulevard and Greenpoint Avenue". In the new R5B areas the maximum residential FAR is "1.35 (2.0 for community facilities)", and buildings are "limited to 33 feet in height, with a 30 foot maximum perimeter wall". The department's own photographs label the types street by street: "One- and Two Family Semi Detached Housing, 65th Place" and "Large Multi-Family Apartment Buildings, 43rd Avenue".

Reading the building before the apartment

Facade inspections apply to properties "higher than six stories" (FISP); City Planning describes the prewar stock here as six-story, and six stories is not higher than six stories, so that is settled address by address. Local Law 97 covers buildings over 25,000 gross square feet, with limits that tighten in 2030 (Local Law 97), which sits awkwardly beside an oil-fired boiler. Queens Community Board 2's list covers "Long Island City, Woodside, Sunnyside" and part of Maspeth (Queens community boards), and District 2 sits in sub-cycle B of the gas piping schedule, next window 1 January to 31 December 2029 (Local Law 152), reaching roughly 88 percent of homes in this ZIP, since only one- and two-family and R-3 buildings are exempt. In a prewar co-op the apartment is the smaller half of the purchase: minutes, reserves and the last facade filing say more than the kitchen does.

Cellars, rainfall and a rule that is not open

Local Law 126 of 2024 names "Queens community district 2" as the only Queens district in its basement program area, and requires that an eligible basement or cellar residence "was in existence prior to April 20, 2024" (Local Law 126 of 2024). Naming a district in a program area is not a route anyone can use: the rule has not been adopted and no application can be filed. A finished cellar room still deserves a direct question. The city reports a storm peak of "3.15 inches of precipitation per hour" against sewers designed for far less, with impacts felt "inland rather than in the coastal areas" (The New Normal); that account is citywide and names no neighborhood. For one lot, the city flood hazard mapper is where to look. On the elevated 7 along Queens Boulevard, none of the stations from 33rd Street to 52nd Street is listed as accessible (MTA subway stations).
